Last time Individual income up to Rs. 12 Lakh was made liable for NIL Income tax vide tax rebate up to Rs. 60,000 under section 87A of the Income Tax Act. This has given a big relief to the people but entails number of complexities viz. oid scheme-new scheme, keeping special tax incomes i.e., capital gains out of section 87A Rebate in mew scheme. Surcharges and cess also make income tax structure complex. Provisions of presumptive scheme under section 44AD and 44ADA are not suitable to partnership firms and better they be kept out of these schemes. Conversion provisions of small companies into LLP under section 47(xiiib)(e) of the Income Tax Act need to be rationalized further. Certain TDS provisions under the Income Tax Law also need to be rationalized. All Suggestions in this regard are attached here with which will definitely ease the living and doing business of Individuals and micro and small enterprises.

The exemption on leave encashment at retirement for non-government employees under Section 10(10AA)(ii) remained fixed at ₹3,00,000 from 2002 to March 2023. Owing to this outdated ceiling, a large number of retirees were subjected to income tax and TDS on legitimate retirement benefits, resulting in undue hardship, particularly to senior citizens. The enhancement of the limit to ₹25,00,000 from 01-04-2023 acknowledges this anomaly. However, employees who retired between 2002 and 2023 continue to be adversely affected solely on account of timing. While ITATs/Courts have granted relief by treating the enhancement as beneficial, such relief is presently available only through litigation. It is therefore submitted that Budget 2026 may provide a legislative clarification for retrospective application (or from an earlier cut-off date) and introduce a one-time mechanism for recomputation and refund with condonation of delay, to ensure equity and reduce avoidable litigation.

I understand that any reduction in taxes related to international trading or overseas investments falls under the jurisdiction of the Central Government and can only be implemented through the Union Budget. Such changes are proposed by the Hon’ble Finance Minister in the Finance Bill and come into effect only after approval by Parliament. Therefore, tax rates applicable to international investments cannot be altered by individual ministers or private platforms and require a formal budgetary decision.

India has the most crypto owners in the world, with 93M+ users. Yet, we still have no clear crypto policy. While countries like Singapore, Dubai, and U.S are trying to become crypto hubs, India is stuck with: - 30% tax on every trade - 1% TDS on every transaction - loss set-off not allowed The innovation behind crypto seems completely ignored. Some numbers to think about: FY 2022-23: ₹221.27 Cr collected as TDS FY 2023-24: ₹362.70 Cr FY 2024-25: ₹511.83 Cr In the last 3 years, India’s Income Tax Department has collected over ₹1,100 Cr from crypto activity. It’s high time India changes its stance on Bitcoin and Web 3.0. We need: - Clear and progressive crypto policies - Lower, simpler taxation to make crypto more accessible (Reduce 30% Flate tax on profit, Reduce 1% TDS, Allow loss set-off) - Special economic zones for crypto and Web 3.0 development - Policies to invite companies & startups to build in India - Education & aware
