Respected Sir, The formal declaration of Emergency marked a turning point in Indian Constitutional history. On 25th June 1975 the then President Shri Fakhruddin Ali Ahmed issued the Emergency proclamation under Article 352 citing threats from internal disturbance. The Emergency provisions, in the Indian Constitution, while designed for extreme situations, have faced criticism for potential undermining fundamental rights, weakening Federalism, and concentrating Power, in the Central Government. Specifically the suspension of fundamental rights, particularly those under Article 19, and the potential for the President to exercise dictatorial powers are major concerns. During National Emergency, particularly when declared war or external aggression, the six freedoms under Article 19 are automatically suspended. This can lead to a curtailment civil liberties, and freedoms. Additionally, the right to life and personal liberty, while not explicitly suspended, can be indirectly affected.
